Jim Tomlinson and John Olah will discuss the recent decisions in Schnarr v Blue Mountain and Woodhouse v Snow Valley.  The Court of Appeal for Ontario held that the Occupiers Liability Act prevails over the general provisions of the Consumer Protections Act and reaffirmed the jurisprudence of waivers in Ontario as a means of managing risk for those who fulfill the CPA definitions of both ‘occupier’ and ‘supplier’.
