Water losses rank the most frequent in the claims world while fire losses are most destructive. How can you maximize your recovery on these losses? Equip yourself with the tools you need to successfully subrogate against any liable parties, no matter what type of loss. From properly preserving evidence during the claims investigation to subrogation in the courts, our forensic and legal experts will show you how to maximize subrogation potential. Highlights on important legal issues and trends in law will provide you with insight on whether to pursue the claim, who to pursue against and how to build the case.

SEMINAR OBJECTIVES

 

  • Determine key guidelines to successfully secure and preserve a scene to avoid “Spoliation of Evidence”
  • Recognize how to document and photograph a scene effectively before involving a forensic expert
  • Determine when to involve a forensic expert
  • Examine a forensic engineer’s investigative process
  • Discuss and examine:
    – Contractual issues such as covenants and waivers
    – Evidentiary issues such as when documents are privileged and how courts consider expert evidence
    – Substantive legal matters such as defences to subrogated claims
    – Procedural issues such as conduct of the claim and inclusion of uninsured loss

 

SEMINAR PRESENTERS

Mia Taghizadeh , Associate, Dolden Wallace Folick LLP,
Mia practices exclusively insurance defence litigation and has advanced subrogated claims in areas spanning property damage, construction deficiencies, disability benefits, and motor vehicle accidents. She appears regularly in the Supreme Court of British Columbia and has appeared in BC’s Provincial Courts. Mia is a member of the Insurance Law and Civil Litigation subsections of the Canadian Bar Association in BC, and often presents to non-legal organizations on how to advance their claims in the courts.

Mazen Habash, President, Origin and Cause
Mazen has 30+ years of industry experience and conducted 3000+ forensic investigations. He is a qualified expert witness in civil and criminal courts in three provinces. His electrical and computer engineering specialities include fire and explosions, electrical failures and malfunctions, product liability, alarm system investigations, and CCTV forensic analysis.

Tom Hoppe, Fire and Explosion Investigator,  Origin and Cause
Tom has over 15 years of industry experience as an investigator and is a qualified expert witness in Federal criminal cases. His forensic specialties include complex and large loss investigations, incendiary fires and explosions, and claims with fatalities.

Number of Continuing Education Credits:  3 Technical
