Date set for appeal in Newfoundland class action lawsuit over moose crashes

ST. JOHN’S, N.L. – A Newfoundland lawyer is moving ahead with an appeal of a provincial Supreme Court decision that dismissed a class-action lawsuit over moose-vehicle crashes.

Ches Crosbie says he will appear Jan. 21 before a three-member panel of Appeal Court judges in hopes they will see the novel case differently and overturn the lower court’s ruling.

Judge Robert Stack of the Supreme Court of Newfoundland and Labrador ruled in September the province is not liable for the collisions and took reasonable precautions.

The lawsuit involved 135 plaintiffs who needed hospital care and at least 15 estates of those killed in collisions since 2001.

Crosbie has said that several million dollars in total compensation was being sought.

In a statement, Crosbie says the appeal hearing is open to the public and is expected to last one day.
